1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the Payo Group Realtors website, dashboard, and related services ("Platform").
By creating an account or using the Platform, you agree to be bound by these Terms.
2. Definitions
Platform means the PAYO website, dashboard, and associated services.
User means any individual or organisation using the Platform.
Buyer means a User looking to buy, rent, or lease property through the Platform.
Agent means a real estate agent or agency registered on the Platform to list and manage properties.
Service Provider means a professional or business offering property-related services on the Platform, such as contractors, lawyers, and mortgage brokers.
Listing means a property advertised on the Platform for sale, rent, short stay, or auction.
3. Eligibility
You must:
- Be at least 18 years old.
- Provide accurate registration information.
- Maintain the confidentiality of your account credentials.
- Be legally capable of entering into binding contracts.
4. Our Services
PAYO provides, among other services:
- Property listings for sale, rent, short stay, and auction
- A directory of agents and real estate companies
- A directory of property service providers
- Property tour scheduling
- Enquiries between buyers, agents, and service providers
- Personalised property recommendations
- Property market insights and articles
PAYO is a marketplace that connects Users. Unless expressly stated otherwise, PAYO is not a party to any sale, lease, or service agreement between Users.
We reserve the right to add, modify, or discontinue services at any time.
5. User Accounts
You agree to:
- Provide truthful information.
- Keep your password secure.
- Notify us immediately of unauthorised access.
- Accept responsibility for activities under your account.
We may suspend or terminate accounts involved in fraudulent or unlawful activities.
6. Verification of Agents and Service Providers
Agents and Service Providers may be required to submit identity documents, licence numbers, and other information before their accounts are approved.
Approval is at our discretion and may be withdrawn at any time.
A verified status means we carried out checks at the time of approval. It is not a guarantee of the quality, conduct, or continued licensing of any Agent or Service Provider.
7. Listings
If you publish a Listing, you confirm that:
- You are the owner of the property or are authorised by the owner to advertise it.
- All information, including price, location, and availability, is accurate and kept up to date.
- You own or have permission to use all photos, floor plans, and other content you upload.
- The Listing complies with all applicable laws.
You grant PAYO a non-exclusive, royalty-free licence to display, promote, and distribute your Listing content on the Platform and in our marketing.
We may edit, decline, or remove any Listing that we believe is inaccurate, misleading, or in breach of these Terms.
8. Property Tours and Enquiries
Tour requests are subject to confirmation by the Agent or property owner.
Where a tour fee applies, it will be shown on the Listing before you request a tour.
Users must behave respectfully during tours and communications, and must not misuse contact details obtained through the Platform.
9. Payments
Payments may be made through approved payment providers including:
- M-Pesa
- Debit Cards
- Credit Cards
- Bank Transfers
- Other approved payment gateways
All prices are displayed in Kenyan Shillings unless otherwise indicated.
10. Property Information Disclaimer
While we make every effort to keep Listings accurate:
- We do not guarantee that every property remains available.
- Listing details are provided by Agents and property owners, who are responsible for their accuracy.
- Users remain responsible for carrying out their own due diligence, including viewing the property and verifying ownership and title, before making any payment or commitment.
11. Service Providers
Service Providers listed on the Platform are independent businesses. PAYO is not responsible for the quality, timeliness, or outcome of services they provide.
Any agreement for services is made directly between you and the Service Provider.
12. Intellectual Property
All content on the Platform including:
- Software
- Logos
- Graphics
- Text
- Articles and market insights
- Databases
is the property of Payo Group Realtors or its licensors, except for Listing content owned by the Users who uploaded it.
No content may be copied, reproduced, redistributed, or sold without written permission.
13. User Conduct
Users shall not:
- Post fake, duplicate, or misleading Listings.
- Misrepresent their identity, licence, or authority to act for a property owner.
- Harass, defraud, or spam other Users.
- Scrape or copy Listings or User data.
- Reverse engineer the Platform.
- Upload malware.
- Attempt unauthorised access.
- Use automated bots without written authorisation.
Violation may result in removal of content and permanent account termination.
14. Availability
We aim for continuous availability but do not guarantee uninterrupted access.
Maintenance, upgrades, or technical failures may occasionally affect service.
15. Limitation of Liability
To the maximum extent permitted by law, PAYO shall not be liable for:
- Lost profits
- Losses arising from transactions between Users
- Inaccurate Listing information supplied by Users
- Acts or omissions of Agents or Service Providers
- Data loss
- Indirect or consequential damages
16. Indemnity
Users agree to indemnify PAYO against claims arising from misuse of the Platform, content they publish, or violation of these Terms.
17. Suspension and Termination
We may suspend or terminate accounts or remove Listings for:
- Fraud
- Fake or misleading Listings
- Illegal activity
- Copyright infringement
- Non-payment
- Abuse of the Platform
18. Changes to These Terms
We may revise these Terms from time to time. Any updates will be published on this page together with the revised effective date.
Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
19. Governing Law
These Terms are governed by the laws of the Republic of Kenya.
Disputes shall be subject to the jurisdiction of Kenyan courts.
